These general terms and conditions ("Terms") apply to your ("You", "Your", "You") use of Creative Database ("Service", "Services") which is provided by Creative Database Technology AB,559424-1183, (“CRDB”, “we”, “us” and “our”), a platform which aims to bring together creative freelancers and employers for recruitment and networking, and to promote skills development and the maintenance of high quality in the creative industries including, but not limited to film, music, theater, art and literature.
Acceptance of the Terms
By registering an account with us and/or using our services, you agree to these Terms. If you do not accept the Terms, you will not be able to access or use the Services.
Registration and User Accounts
To use the Services, you must register an account with us and provide certain information about yourself that is requested by us. You warrant that all information you provide is accurate and up-to-date.
The handling of the information made available takes place in accordance with our Privacy Policy.
You are solely responsible for protecting your account password and for all use of your account.
Our Rights
We reserve the right to refuse you the provision of the Services for any reason, including but not limited to breach of these Terms.
We further reserve the right to remove any content that violates these terms.
Use of the Services
You may only use the Services for legal purposes and in a manner that does not conflict with these Terms, applicable law or rights of third parties.
You may not upload, display, send, transmit or otherwise make available any material that you do not own rights to according to law or agreement. In addition, you may not display, upload, send, transmit or otherwise make available material such as;
is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene,offensive of someone's integrity, hateful, racist, ethnically or otherwise offensive;
you know (or should reasonably know) is false, misleading or untrue;
constitutes or encourages illegal activity;
offends any partyright, including but not limited to patent, trademark, trade secret, copyright, right of publicity or other intellectual property, or privacy and data protection rights.
Intellectual property rights
CRDB does not claim ownership over the materials or works ("User Content") published by its users on the platform. Users are entitled to upload content, including but not limited to photographs, illustrations, written content, and other creative materials, only when they possess the copyright or are acting pursuant to a license, agreement, or other lawful grant of rights, permitting such publication without contravention of any applicable laws or third-party agreements.
CRDB bears no responsibility for the content published by its users and does not guarantee that such content will not infringe upon any laws or third-party rights. CRDB can only act based on the assurances and warranties provided by users in conjunction with their use of the Services and the publication of User Content.
In the event that CRDB becomes aware that User Content may be in violation of these terms, or there exists a credible risk of such violation, CRDB reserves the right to remove such content. It is, however, critical to note that CRDB cannot assure the removal of such content prior to its dissemination within the Services.
Users assume sole responsibility for their User Content and any potential ramifications stemming from its publication. By publishing User Content on the platform, users certify and warrant that they possess all necessary licenses, rights, permissions, and consents required to do so, and to enable CRDB to utilize the User Content in accordance with these terms.
User Interactions and Third Party Content
You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise inappropriate according to your preferences.
You agree that any interaction with other users of the Services is at your own risk and that CRDB is not responsible for any negative outcome of such interactions.
Linking to Third Party Sites
The Service may contain links to other websites that are not owned or controlled by CRDB. We are not responsible for the content, privacy policies or operations of such third party websites.
Limitation of liability
CRDB shall not be liable for any direct, indirect or incidental damages, including but not limited to damages for lost profits, revenue, goodwill, use, data or other intangible losses, resulting from the use of the Services.
Changes to the Terms
CRDB reserves the right to change these Terms at any time. New versions of the Terms will be posted on the Service and we will inform you of the changes by email or through the Service.
Validity and Amendment of the Agreement
These Terms apply as long as you have an account with us, or as long as you use the Services, and for a reasonable time thereafter.
CRDB reserves the right to change or terminate the Services, or any part thereof, at any time without prior notice.
Security and Privacy
The user is responsible for the security of his account and password. The User shall immediately notify CRDB if there are suspicions of unauthorized use of the User's account or breach of security.
The user undertakes to respect the privacy of other users and not to collect or disseminate personal data without the express consent of the person concerned.
Rights and Obligations for Employers
Employers using the Services to find potential job candidates agree to comply with all applicable laws and regulations regarding recruitment and employment.
Applicable Law and Dispute
To the extent of a dispute due to your use of the Services or otherwise based on the regulation that takes place through these Terms, such dispute shall be referred to the Gothenburg district court, whereby Swedish law shall be applied.
