These General Terms and Conditions (“Terms”) govern your use of the Creative Database platform and services (“Services”) provided by Creative Database Technology AB (“CRDB”, “we”, “us”, “our”).
Creative Database operates as an agent and brokerage service connecting creative freelancers (“CRDB Talent”) with businesses and individuals seeking creative work (“CRDB Clients”). All work brokered through the platform runs exclusively via Creative Database — we source, match, scope, and manage each engagement on behalf of both parties.
By registering an account and/or using our Services, you agree to these Terms in full. If you do not accept them, you may not access or use the Services.

To use the Services, you must register an account and provide accurate, up-to-date information as requested. You are solely responsible for maintaining the security of your account and password. If you suspect unauthorised access, notify us immediately at jobs@creativedatabase.io.
We reserve the right to refuse or suspend access to the Services for any reason, including breach of these Terms.

Creative Database acts as a commercial agent between CRDB Talent and CRDB Clients. This means:
- We source, negotiate, and structure each engagement.
- All commercial communication regarding rates, timelines, and project terms is handled by or together with CRDB.
- All invoicing runs through CRDB — neither party invoices the other directly.
- We step in to mediate if any dispute arises between the parties.
Neither CRDB Talent nor CRDB Clients may circumvent Creative Database by entering into direct commercial arrangements with one another for work that originated through our platform. If you wish to continue working with someone you were introduced to through us, that engagement must be arranged through Creative Database.

You may only use the Services for lawful purposes and in a manner consistent with these Terms, applicable law, and the rights of third parties.
You must not upload, transmit, or publish material that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise offensive;
- You know or reasonably should know is false or misleading;
- Encourages or constitutes illegal activity;
- Infringes any intellectual property, privacy, or data protection rights.

CRDB does not claim ownership over content published by users on the platform (“User Content”). By publishing User Content, you confirm that you hold all necessary rights, licences, and permissions to do so, and that doing so does not violate any law or third-party agreement.
CRDB bears no responsibility for User Content and does not guarantee it is lawful or free from third-party claims. We reserve the right to remove content we reasonably believe violates these Terms or applicable law.
By engaging with Creative Database as CRDB Talent, you grant CRDB a non-exclusive licence to use work produced through our platform for promotional purposes — including paid advertising and organic content. Where work is featured, we will credit you by name wherever reasonably possible.

All parties agree to treat project-related information — including briefs, strategies, pricing, business information, and creative materials — as confidential. This information may not be shared outside the project without the express consent of the disclosing party.
This obligation applies to CRDB Talent, CRDB Clients, and Creative Database equally.

For CRDB Talent:
You invoice Creative Database only — never the client directly. Invoices should be sent to jobs@creativedatabase.io and include the project name or reference, dates of service, agreed rate, and VAT (MOMS).
- Standard payout: Payment within 30 days of invoice receipt. You receive 90% of the agreed project rate; CRDB retains 10% as the brokerage fee, unless otherwise agreed in writing.
- Early payout: If you need payment sooner, request it in writing when submitting your invoice. We will pay the next business day. In this case, the brokerage fee is 20% and you receive 80% of the agreed rate, unless otherwise agreed in writing.
For CRDB Clients:
You will be invoiced by Creative Database only — you will never receive an invoice directly from a freelancer. Payment is due within 20 days of the invoice date. Before any project begins, you must provide your company name, billing address, and organisation/VAT number.
Ownership of all deliverables transfers to the Client upon receipt of full payment. Until that point, the work remains the intellectual property of the freelancer and may not be used commercially.

If a dispute arises between CRDB Talent and a CRDB Client — regarding scope, quality, timelines, or any other matter — Creative Database will act as mediator and represent both parties’ interests in reaching a fair resolution.
CRDB shall not be liable for any direct, indirect, or incidental damages resulting from use of the Services, including loss of profits, revenue, data, or goodwill.

We store contact, company, and payment information as necessary to operate the Services and fulfil our contractual obligations. We comply with GDPR and all applicable EU data protection law. We do not sell or share your data outside of what is required to run this agreement.
You may request access to, correction of, or deletion of your data at any time by contacting jobs@creativedatabase.io.

The Services may include links to or content from third-party websites. CRDB is not responsible for the content, privacy practices, or operations of any third-party site.
You may be exposed to User Content that does not reflect your preferences. Any interaction with other users is at your own risk.

CRDB reserves the right to amend these Terms at any time. Updates will be posted on the platform and communicated by email or in-app notification. Continued use of the Services following notification constitutes acceptance of the revised Terms.

These Terms are governed by Swedish law. Any dispute arising from or related to these Terms or the Services that cannot be resolved between the parties shall be referred to the District Court of Gothenburg (Göteborgs tingsrätt).

These Terms apply for as long as you hold an account with us or use the Services, and for a reasonable period thereafter. CRDB reserves the right to modify, suspend, or terminate the Services or any part thereof at any time without prior notice.
